TERMS AND CONDITIONS

These Terms and Conditions constitute a legally binding agreement made between you ("the User") and Boljoro SL ("the Company") concerning your access to and use of the www.storiesandroleplay.com website and its subdomains ("Stories and Roleplay").

By creating an account, accessing the platform, or purchasing credits, you acknowledge that you have read, understood, and agreed to be bound by the entirety of these Terms.

1. Description of Service & EU AI Act Compliance

Stories and Roleplay is an automated, interactive business-to-consumer (B2C) text generation utility. The service provides a software framework enabling users to design custom parameters, fictional character personas, and specific plot constraints to dynamically prompt a generative Large Language Model (LLM) to write adult, erotic, fictional narratives.

Mandatory AI Disclosure: In strict compliance with Article 50 of the European Union Artificial Intelligence Act (EU AI Act), you are hereby explicitly notified that you are interacting with an automated, generative artificial intelligence system. All characters, stories, responses, interactions, and text outputs provided by the engine are entirely synthetic, machine-generated, and completely fictional.

2. Eligibility, Age Declaration, and Jurisdictional Restrictions

• Absolute Age Requirement: Stories and Roleplay is strictly reserved for adult audiences. You must be at least 18 years of age, or the legal age of majority in your place of residence if that is higher (19 or 21 in certain US states, Canadian provinces, South Korea, and Puerto Rico), to register an account, purchase tokens, or interact with the platform.
• Self-Declaration: At registration you must provide your true date of birth and select your country (and, for the United States and Canada, your state or province). Providing a fraudulent birth date or location to bypass this filter constitutes a material breach of contract and will result in account termination.
• Third-party age verification: Access from certain jurisdictions (including the United Kingdom, Australia, France, Italy, Brazil, Germany, South Korea, and listed US states) requires successful age verification with our provider Didit. Germany and South Korea require a government-ID check; the others use selfie age estimation, with an ID fallback if the estimate is uncertain. Failing verification blocks the account. If you believe the decision is wrong, you may submit an appeal from the verification page. Our staff may then allow a retry or delete the account so the email can be used to register again.
• Restricted territories: We do not serve sanctioned countries, high-risk financial jurisdictions, or territories where distributing adult content is a criminal offence. We also do not serve Russian-occupied regions of Ukraine. Attempting to bypass these restrictions via VPNs, proxy manipulation, or IP masking is prohibited. Network geolocation is combined with the location you declare; the stricter of the two rules applies.

3. Acceptable Use Policy, Prohibitions, and Safety Disclaimer

You are granted a revocable, non-exclusive, non-transferable license to access our text generation platform strictly for personal, private creative entertainment. You explicitly covenant and agree that you will not input, steer, request, or attempt to generate content depicting or containing any of the following:

• Minors: Absolutely no scenarios, text prompts, character configurations, or depictions involving minors or individuals under the age of 18 in an erotic, sexual, suggestive, or explicit context. Our internal automated filters monitor and intercept inputs aggressively; any attempt to generate content involving minors will trigger an immediate, irreversible, automated account termination.
• Real Persons: You are strictly prohibited from using the names, real-world identities, addresses, or distinct personal characteristics of real, living, or deceased individuals in your custom character variables or scenarios. All characters created on the platform must be entirely fictional entities.
• Harassment and Extortion: You are strictly prohibited from utilizing the platform to generate, facilitate, or orchestrate narratives intended for blackmail, extortion, targeted cyberbullying, stalking, defamation, or the real-world intimidation of any person. Generating content designed to coerce, threaten, or cause genuine psychological or reputational distress to an external party constitutes an immediate violation of these terms. Platform outputs are strictly for internal, private exploration and must never be weaponized against real-world individuals.
• Illegal Activities: You may not use the service to generate text narratives that depict, encourage, or provide instructions for real-world physical violence, non-consensual sexual acts, sexual assault, or any interactions that constitute a criminal offense under applicable jurisdictions.

Consequences of Violations

If Boljoro SL determines, in its sole discretion, that you have violated our Acceptable Use Policy, we will enforce the immediate, permanent termination of your account and UUID metadata without warning and without a refund. We reserve the right to block your technical network metrics permanently and report severe infractions to competent law enforcement bodies.

4. Use of Outputs and Commercial Restrictions

• Personal Entertainment License: All narrative text, character descriptions, and story lines generated for you by our platform are provided strictly for your personal, private, and non-commercial entertainment.
• Prohibition on Commercial Exploitation: You are explicitly prohibited from selling, licensing, sub-licensing, monetizing, or otherwise using the AI-generated text outputs for any commercial purpose, financial gain, or business exploitation. Utilizing platform outputs for commercial projects constitutes a material breach of this contract and will result in immediate account termination.
• Ownership Status: In accordance with European Union and Spanish intellectual property frameworks, purely machine-generated synthetic text lacks the human ingenuity required to claim traditional legal copyright. While Boljoro SL claims no proprietary copyright over raw synthetic text outputs, your right to use said text is strictly bound and restricted by the non-commercial terms of this user agreement.

5. Free Accounts, Subscriptions, Payments, and The Token Wallet

Stories and Roleplay operates a hybrid monetization model utilizing non-converting free starter credits, expiring subscription tokens, and non-expiring purchased wallet tokens:

• Free Account & Starter Credits: Upon registration, new accounts receive ten (10) complimentary starter credits. No credit card, payment details, or financial commitment is required to create a Free Account. The Free Account does not automatically convert into a paid subscription or recurring charge. When starter credits are exhausted, your account remains active, and you retain access to all your saved stories, characters, and created content. Continued generation beyond starter credits is entirely voluntary and requires a manual purchase of token packs or a subscription. There are zero hidden or unexpected charges.
• Subscription Cycles: Monthly subscriptions are billed automatically on the anniversary date of your initial enrollment (e.g., a subscription initiated on June 5 will automatically renew on July 5). Subscriptions unlock premium features, extended history tools, and access to our advanced/premium Large Language Models.
• Subscription Credit Expiry: Each subscription tier includes a specific monthly allocation of tokens. These included subscription tokens do not roll over; any unused subscription tokens expire automatically at the conclusion of your billing cycle. If your payment method fails on your renewal date, your subscription tokens will immediately drop to zero and access will be restricted until billing parameters are successfully updated.
• The Purchased Token Wallet: Users may purchase extra token packs separately. These credits are stored in an independent "Wallet". Wallet tokens never expire and remain on your account indefinitely.
• Consumption Hierarchy: Our system automatically optimizes your token spend. Subscription tokens facing imminent monthly expiration will always be consumed first. Your purchased Wallet tokens will only be drawn down after your subscription tokens have been completely exhausted.
• Model Downgrade Restrictions: You may consume your purchased Wallet tokens even if you do not maintain an active monthly subscription. However, if your subscription is inactive or cancelled, your Wallet tokens can only be used to generate stories on our Basic Model. Access to our premium or advanced model variations strictly requires an active, paid subscription tier.

6. Cancellation and Refund Policy

You may cancel your monthly subscription at any time via your account settings. Boljoro SL operates on a strict no-refund policy for partial or pro-rated billing intervals. Upon processing your cancellation, your premium privileges and remaining subscription tokens remain active and usable until the final day of your current paid billing period, at which point the subscription will formally expire without further renewal charges.

7. Explicit Waiver of EU Right of Withdrawal

Under European Union consumer protection frameworks, consumers generally maintain a 14-day right of withdrawal for digital purchases. However, because our AI text generation service delivers instant, immutable digital content execution upon request, you explicitly acknowledge and agree that when you purchase a subscription or a token pack, you request immediate performance of the service. You hereby waive your statutory 14-day right of withdrawal and refund the moment our system generates the first line of text for your account.

8. Disclaimers and Limitations of Liability

• Dynamic Generation Disclaimer: Content is rendered live by an automated artificial intelligence model. Boljoro SL does not guarantee semantic accuracy, continuous continuity, or compliance with your desired creative intent. The service is provided on an "as-is" and "as-available" basis.
• Limitation of Damages: To the maximum extent permitted by applicable Spanish law, Boljoro SL shall not be held liable for any psychological distress, unintended offensive text outputs, or emotional impact resulting from your text steering or generative outputs. In no event shall the total aggregate liability of Boljoro SL exceed the total monetary amount paid by the User to the Company during the three (3) months immediately preceding the event giving rise to the claim.

9. Governing Law and Jurisdiction

These Terms and Conditions, along with your use of the website and any legal disputes arising therefrom, shall be governed by, interpreted, and enforced strictly in accordance with the laws of Spain.

Any legal action, lawsuit, or judicial proceeding arising out of or in connection with these terms shall be brought exclusively before the competent courts located in the city of Barcelona, Spain.
